1. Acceptance of Terms

By downloading, installing, or using MomRise ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

MomRise is a parenting companion application that provides:

• Child development milestone tracking
• AI-powered learning path generation
• Activity suggestions based on mood and preferences
• Meal planning tools
• Calendar and scheduling features
• Reusable routines and checklists

3. User Accounts

To use certain features of the App, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Billing, Subscriptions, and Refunds

Free trial: New MomRise subscriptions begin with a 7-day free trial. You are not charged during the trial, and you can cancel any time before the trial ends to avoid being billed. This trial is your opportunity to evaluate the full app before committing.

Subscription fees: After the trial, MomRise is $6.99/month or $69.99/year, billed automatically through the payment method on file until you cancel. Prices may change with notice; any change will apply only to renewals after the effective date.

Cancellation: You can cancel your subscription at any time from your account settings (or through your Apple or Google account if you subscribed through the App Store or Play Store). Cancellation stops future billing; you keep access for the rest of the current paid period.

No refunds: Because the 7-day free trial lets you fully evaluate MomRise before any charge, we do not issue refunds for completed billing periods — including partial months, unused time, or accidental renewals. If you cancel, your access continues until the end of the period you already paid for.

App Store and Play Store purchases: If you subscribed through Apple's App Store or Google Play, their refund policies apply, and any refund request must be made directly to them.

Chargebacks: Initiating a chargeback on a subscription charge after the trial period may result in immediate termination of your MomRise account. If you believe a charge is in error, contact us first at support@momrise.app.

5. User Content

You retain ownership of any content you submit to the App (such as child information, notes, or preferences). By submitting content, you grant us a license to use, store, and process this information to provide our services.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Share your account credentials with others
• Use the App to harm or exploit children in any way

7. AI-Generated Content

The App uses artificial intelligence to generate learning paths and activity suggestions. While we strive for accuracy and helpfulness:

• AI-generated content is for informational purposes only
• It should not replace professional medical, developmental, or parenting advice
• Always use your judgment as a parent when implementing suggestions
• Consult healthcare professionals for medical concerns

7a. Health, Nutrition, and Baby-Feeding Content

MomRise includes meal-planning, nutrition, and infant-feeding content — including, where available, age-stage guidance, cutting and serving suggestions, and allergen flags for foods given to babies and young children. This content is educational only and is not medical advice.

By using these features, you acknowledge and agree:

• Not a substitute for professional advice. Nothing in the App constitutes medical, nutritional, lactation, or pediatric advice. Always consult your pediatrician, registered dietitian, or other qualified healthcare professional before making feeding decisions for your child, particularly regarding allergens, choking risks, dietary restrictions, or special medical needs.
• You supervise meals. Babies and young children must be actively supervised by an adult during every meal and snack. The App does not and cannot supervise feeding.
• Choking risk is real. Foods served to infants and young children carry choking risks regardless of preparation. The App's guidance on cutting, serving size, and texture is based on general public-health sources (such as the American Academy of Pediatrics and the Centers for Disease Control and Prevention) but does not eliminate risk. You are responsible for assessing each food, each meal, and your specific child's developmental readiness.
• Allergen information is general. Allergen flags reflect commonly-identified allergens and do not substitute for medical allergy testing or a physician-supervised allergen introduction plan. If your child has known or suspected allergies, consult a board-certified allergist before introducing new foods.
• Sources cited where available. Where the App references AAP, CDC, or other authoritative sources, those sources are credited. Any errors in transcription or interpretation are unintentional; you should consult the original source for definitive guidance.
• No guarantees. MomRise makes no warranty that any feeding suggestion is safe for your specific child. Children differ in developmental stage, medical history, allergies, and risk tolerance. Use the App's guidance as one input among many, alongside professional advice.
• You assume risk. To the maximum extent permitted by law, you assume all risk arising from your use of the App's nutrition and feeding content, including but not limited to choking, allergic reactions, foodborne illness, and adverse nutritional outcomes.

Where applicable, specific food entries may be marked as having been reviewed by a Registered Dietitian or other credentialed professional. Such review reflects the reviewer's professional opinion as of the date noted and does not constitute medical advice, ongoing care, or a personalized recommendation for your child.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be error-free or uninterrupted
• Any specific results will be achieved from using the App
• The App will meet your specific requirements

9. Limitation of Liability

To the maximum extent permitted by law:

• MomRise and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses, resulting from your use of (or inability to use) the App.
• MomRise's total cumulative liability to you for any and all claims arising out of or related to the App, regardless of cause of action or theory of liability, shall not exceed the greater of (a) the total subscription fees you have paid to MomRise in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred US dollars ($100).
• This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if MomRise has been advised of the possibility of such damages.
• Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, MomRise's liability is limited to the maximum extent permitted by law.

9a. Indemnification

You agree to indemnify, defend, and hold harmless MomRise, its officers, employees, contractors, and affiliates from and against any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any feeding, nutrition, health, or supervision decisions you make in connection with the App's content (including but not limited to choking, allergic reactions, foodborne illness, or adverse outcomes for any child in your care)
• Content you submit to the App, including imported recipes, photographs, or text

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new terms.

11. Termination

We may terminate or suspend your account at any time for violations of these terms. You may also delete your account at any time by contacting support.

12. Recipe Content and Copyright

MomRise allows users to import recipes from external websites for personal use, and allows approved creators to publish and sell recipes through the platform. By using any recipe feature, you acknowledge and agree that:

• Imported recipes are stored in your personal account for your own use
• You are solely responsible for ensuring that your use of imported content complies with applicable copyright laws and the terms of service of the original website
• MomRise attributes all imported recipes to their original source and provides links back to the original website
• Ingredient lists and basic cooking instructions are factual in nature and are not subject to copyright protection under US law; however, photographs, original written instructions, and other creative expression accompanying a recipe may be protected by copyright
• You will not use MomRise to systematically reproduce, distribute, or commercially exploit copyrighted recipe content for which you do not hold the rights
• When you save or publish a recipe through MomRise's creator tools, you represent and warrant that you either (a) created the recipe yourself, (b) hold a license or written permission from the original creator, or (c) have transformed the recipe sufficiently that the version you save is your own original work
• You will indemnify and hold MomRise harmless from any claims arising from your breach of the representations above
• MomRise complies with the Digital Millennium Copyright Act (DMCA), has a registered DMCA agent, and operates a Repeat Infringer Policy: accounts that receive two or more valid takedown notices (or demonstrate a pattern of unauthorized use) will be terminated at MomRise's sole discretion. 13. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
