DMCA Takedown Policy

MomRise respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our service.
Reporting Copyright Infringement
If you believe that content available through MomRise infringes your copyright, please send a written notification containing the following information to our designated DMCA agent:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material (e.g., a description of the recipe, the URL where it was shared from, etc.)
- Your contact information, including your address, telephone number, and email address
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

How We Handle Claims
Upon receipt of a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material promptly (typically within 1-3 business days)
- Notify the user who posted the material that it has been removed and forward the notice to them
- Provide the user with the opportunity to file a counter-notification (see below)
- Apply our Repeat Infringer Policy to the user's account
Repeat Infringer Policy
In accordance with the DMCA and other applicable copyright laws, MomRise has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.
For purposes of this policy, a user is considered a repeat infringer if:
- The user has been the subject of two (2) or more valid DMCA takedown notices that have not been successfully contested via counter-notification; or
- The user has demonstrated a pattern of uploading or sharing content for which they do not hold the rights, regardless of whether a formal DMCA notice has been received.
Repeat infringers will have their accounts terminated, any associated payouts may be withheld pending review, and they may be prohibited from creating new accounts on MomRise. Decisions about repeat-infringer termination are made at MomRise's sole discretion based on the totality of the circumstances.
Counter-Notification
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us containing the following:
- Your physical or electronic signature
- Identification of the material that has been removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district
Recipe Content
MomRise allows users to save recipes from external websites for personal use. We display ingredient lists and basic cooking instructions, which are generally factual in nature. We always attribute recipes to their original source and provide links back to the original website.
If you are a recipe creator or food blogger and would like your content removed from our platform, please contact us at dmca@momrise.app and we will remove it promptly.
Good Faith
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages.
